Understanding the Virginia Court System

There are four levels of courts in Virginia: district courts, circuit courts, the Court of Appeals and the Virginia Supreme Court along with specialized courts for juvenile and family concerns.

The general district court hears criminal cases involving misdemeanors that entail penalties of up to one year. Felony counts are heard by the circuit court, which is the only trial court of general jurisdiction in Virginia.

The Role of the Magistrate

Often, the first contact our clients will have with the court system is the Magistrate. The job of the magistrate is providing an objective view of complaints brought by law enforcement and private citizens.
Magistrate generate warrants, summons, bonds, search warrants, subpoenas and more. They also handle bond hearings to set bail in instances of a criminal offense.
