Domestic Assault and Protective Orders

unhappy coupleIn Northern Virginia, it is a law enforcement policy to arrest at least one person when responding to a domestic violence call. In the past, police were willing to let couples work things out on their own if the situation had calmed down and both parties were willing, but in too many cases tempers would flare again and the police would receive another call. If someone is arrested, the police will also obtain a protective order for the benefit of the party who was not arrested. This protective order lasts for 72 hours and is intended to provide a cooling-off period between the parties.

This protective order, known as an emergency protective order, can be extended at a full hearing on the request. This extension can last up to two years.
